PUBLIC INPUT AT BOARD MEETINGS:

An opportunity for the public to address the Board on public interest items will be provided for up to two (2) minutes per person for a cumulative

total of twenty (20) minutes. Testimony shall be limited in content to matters which are within the subject matter jurisdiction of the Board. The Board may not take any action on matters discussed during the public comment period.

The Board will also provide an opportunity for the public to address the Board on agenda items before or during consideration of the item for up to

two (2) minutes per person for a cumulative total of up to ten (10) minutes.

Members of the public who wish to speak under public comments or on any item are required to complete a speaker card for each item they wish to

address, and present the completed card(s) to the Executive Officer prior to the time the item is announced by the Chair. Speaker cards are available at the back of the Board Hearing Room. Failure to submit the speaker card in a timely manner may preclude a member of the public from speaking during the subject comment period.

VOTING AND DISPOSITION OF ITEMS - Items require a majority vote of the entire membership of the Board (3 votes) for approval.

Any member of the Board may move to reconsider any vote on any item on the agenda, except to adjourn, suspend the Rules, or where an intervening

event has deprived the Board of jurisdiction, providing that said member originally voted on the prevailing side of the item. The motion to reconsider shall only be in order once during the meeting, and once during the next regular meeting. The member requesting reconsideration shall identify for all members present the Agenda number, meeting date and subject matter previously voted upon. A motion to reconsider is not debatable and shall require an affirmative vote of three members of the Board.

provided irrigation for a minimum three year period after planting.

ALTERNATIVE METHODS AND OPTIONS EXPLORED:

The location, size, and condition of the trees negate the possibility of tree preservation or relocation.

RECITAL:

South Echo Apartments, LLC is constructing a two-hundred-two unit residential condominium complex at 330 North Westlake Avenue as part of

CPC-2007-5307-ZC-SPR. Contained in the entitlements are Bureau of Engineering requirements including street widening, driveway installation, and other related street improvements. Mr. Jorge Estrada, property owner representative, applied to the Bureau of Engineering (BOE) for a Construction Class uB Permit to widen the street as part of the conditions to construct the project. The BOE informed Mr. Estrada the required street widening may necessitate street tree removals. Therefore, Mr. Estrada contacted the Bureau of Street Services (Bureau) requesting the project site be inspected to determine what the impacts will be on the street trees due to the street widening.

Within the contents ofthe Letter of Determination, the Bureau of Engineering condition of approval under improvements 5)(c)(2) requires the developer

to widen Temple Street from a twenty-eight feet half roadway to a thirty-five feet wide half roadway.

A Bureau Arborist inspected the location on December 9, 2016 and on November 2,2017. The inspection revealed four Weeping Bottle Brush (Calistemon

viminalis) trees, one Mexican Fan Palm (washingtonia robusta), and one Carrotwood (Cupaniopsis anacardioides) tree growing in front ofthe address on North Westlake Avenue; three Indian Laurel Fig (Ficus microcarpa) trees and one Queen Palm (Syagrus romanzoffiana) tree growing on West Temple Street side; and six Weeping Bottle Brush trees growing on North Bonnie Brae Street. All trees are in fair to poor condition and growing in four feet tree wells in nine feet six inch to twelve feet sidewalks.

Three Indian Laurel Fig trees measuring approximately thirty-three inches in diameter by forty-five feet in height and one Queen Palm tree measuring

approximately sixteen inches in diameter by thirty feet in height growing on West Temple Street are located within the footprint of the proposed new roadway and will be severely impacted by the required street widening. One Weeping Bottlebrush tree (F3) growing in front of the address and one Weeping Botttlebrush tree (R2) growing on the rear of the property on Bonnie Brae Street measuring approximately eight to fourteen inches in diameter by twenty-five feet in height are located within the footprint of the proposed new driveways and will be severely impacted by driveway construction. The remaining ten street trees will be minimally impacted and retained in place.

Due to the scope of the project, the required root pruning to allow the trees to remain without significantly and adversely affecting the tree health

and root structural integrity is not possible. Therefore, the required street widening and driveway installations require the removal of six trees.

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA): The Department of City Planning prepared a MND (Case No. ENV-2007-5038-MND) for the project finding the

project will have a less than significant environmental effect with the incorporation of Mitigation Measures IV-E as identified in the MND. The Bureau reviewed the project MND and compared the appropriate MND language with the tree removal application. The SSS determined the project MND properly addresses the tree removals proposed for this project. The project MND was utilized in forming the recommendations in this report and is on file with the Bureau and available to the public upon request.

Marisol Rodriguez, Thirteenth Council District Office, was informed of the tree removal request on December 5,2017. The Council Office will inform

any persons inquiring of the opportunity to be heard by the Board at the public hearing for the tree removal permit request.

A Bureau Arborist inspected the location on December 9, 2016. The inspection revealed three Indian Laurel Fig trees and one Queen Palm tree growing

on West Temple Street. One Bottle Brush tree growing on North Bonnie Brae Street and one Bottle Brush tree growing on North Westlake Avenue. The three Indian Laurel Fig trees measure approximately thirty-three inches in diameter by forty. five feet in height growing in four by four feet tree wells. The one Queen Palm tree measuring sixteen inches in diameter by forty feet in height growing in a four by four feet tree well. Two 80ttle Brush trees measuring eighI to fourteen inches in diameter by twenty-five feet in height growing in four by four feet tree wells. Ail listed trees are in fair condition. The three Indian Laurel Fig trees and one Queen Palm tree are in the footprint of the proposed new roadway and the two Bottle Brush trees are in the footprint of the proposed new driveways.
