the Rockland County

rade Project ('Project) will replace the RocklandCounty Sewer District No. I's ("District') existing main pump station at the wastewater reatmentplant ("MNTP') in Orangeburg; andThe Project includes the replacement of all six pumps. motors, shafts, variablespeed drives, pump controls, all piping and valves, the heating and ventilation systems as •we" asbuilding improvements; andWHEREAS The main pump station must be capable of reliably pumping all of the plantflow, which could be up to 80 million gallons a day during major wet weather events; andWHEREAS. The existing pump station equipment has exceeded its useful life and isbeyond economical repair, and replacement parts are not readily available; andWHEREAS, A detailed engineering report titled Main Pump Stathn project datedJanuary 2018 has been prepared by Martin J. Dolphin, P.E. es that the annualsalary of the District Attorney be at least equal to the annual salary of the County Court Judge of the samecounty in which the District Attorney serves; andWHEREAS , On December 24, 201 S, the New York State Commission on Legislative, Judicial, andExecutive Compensation issued a Final Report on Judicial Compensation and such report includesrecommendations with respect to the compensation levels of judges and justices Of New York State courtsof the Unified Court System; andWHEREAS, The New York State Office of Court Administration advised that no legislative actionwas taken and that, therefore. the recommendations of the Commission shall be implemented in New YorkState for four years, to commence in 2016; andWHEREAS, Resolution NO. 381 of 2017 set the salary Of the Distrk:t Attorney for 2017 inaccordance with the Commission's recommendatbns; andWHEREAS, Based upon the Commission's recommendations. a County Court Judge in the Countyof Rockland shall be paid a 2018 annual salary of $197.600•, andWHEREAS, Salary increases have beel implemented for judges and justices of he New YorkState courts of the Unified Court System, effective Apn 5, 2018: andWHEREAS, No new Rockland County funds are required: as sufficient funds exist within the DistrictAttorney's 2018 Budget (Dept. 1165, line 3600) to cover the rænaini,ng needed for the period April5, 2018 through December 31, 2018: andWHEREAS. TO BAN "PHARMACY GAG ORDERS"WHEREAS, a number of pharmacies and pharmacists have had to enter into c

ontracts with healthcarriers or pharmacy benefits managers that contain gag orders that prohibit pharmacists from te"ingcustomers that they could save money by paying cash for prescription drugs rather than using their healthinsurance, and penalize them for disclosing said andWHEREAS, these clauses force pharmacists to remain silent as, for exampk, a customer pays$125 under his/her insurance plan for an influenza drug that would have cost $100 if purchased with case,with much of the difference going to the drug benefit andWHEREAS, according to the Prescription Drug Resource Center of the National Conference ofState Legislators, at least 21 states have enacted laws in the 'ast two years prohibiting pharmacy gag rules,with legislation passed in Arizona: Colorado, Florida, Indiana. Kansas, Kentucky. Mississippi, Utah. Virginiaand West Virginia between March and May of this year, and there is legislation pending in at least six otherstates including New York; andWHEREAS, bills A.9893/S_7191A would prohibit a pharmacy services contract between apharmacist and a health carrier or pharmacy benefits manager from containing language prohibiting orpenalizing the pharmacist frorn disclosing certain information regarding the purchase of prescriptionmedication to a customer purchasing a prescription medication; andWHEREAS, under this legislation, pharmacy benefits managers and insurers cannot require anindividual to pay for a covered prescription medication in an amount greater that the lesser of the following:1) applicable copayment 2) allowable claim amount; or 3) amount an individual would pay for theprescription if they were to have paid without using an insurance p'an or other source of drug benefits ordiscounts; andWHEREAS, pharmacists — who are often the most direct and personal connection that a patientreceiving a prescription drug has — must be freed ofthe constraint of these orders to be able to properlyserve patients and customer when it comes tc their medtation, particularly when some patients may forgobuying necessary medications due to their high cost; andWHEREAS, The Multi-Services Committee Of the Legislatre has met, considered andunanimously approved this resolution; now therefore be itRESOLVED, that the Legislature of Rockland County hereby urges the New York Legislature topass Bills A.9893/S.7191A — an act to amend the public Health Law and the Insuranæ Law to ban"pharmacy gag orders" - and urges the Governor to sÉn such legislation; and be it furtherRESOLVED, that the Clerk to the Legislature be and is hereby authorized and directed to send acopy of this resolution to the Hon. TO THE ROCKLAND COUNTY COMMUNITY SERVICES BOARDWHEREAS, Article 41 of the New York State Mental Hygé

ne Law provides for theestablishment of a Community Services Board CBoard•) for local go•xnment, composed of fifteen(15) members, who either have certain professional qualifications or represent communityinterest in all of the problems of persons with mental disabilities. and further provøes that eachmember shall be appointed for a four-year term; andWHEREAS, Article 41 of the New York State Mental Hygiene Law also requires thatwherever practical, a psychologist and a physician or two physicians be appointed to the Board;WHEREAS, Section C9.03 of the Charter Law of Rockland County established theRockland County Community Services Board and provides that it shar be constituted in accordancewith the Mental Hygiene Law. whose members shall be appointed by the County Executive, subjectto confirmation by the Legislature; andWHEREAS, Section C3.02 of the Charter Law of Rockland County provides that theCounty Executive shall appoint members of all county boards and commissions, subject tolegislative confirmation; andWHEREAS, Article 41 of the New York State Mental Hygiene Law has been supersededby. to the extent that it is hconsistent with Section C3.02 of the Charter Law of Rockland Countywhich provides that members Of County boards and commissøns shall serve at the pleasure of theCounty Executive: andWHEREAS, The appointment of Julio Barros, Orangeburg, New York has beenrecommended by the Commissioner of Mental Health to fill a vacamy on the Board; andWHEREAS , The County Executive has appointed Julio Barros, Orangeburg, New York to
