PUBLIC INPUT AT BOARD MEETINGS:

An opportunity for the public to address the Board on public interest items will be provided for up to two (2) minutes per person for a cumulative

total of twenty (20) minutes. Testimony shall be limited in content to matters which are within the subject matter jurisdiction of the Board. The Board may not take any action on matters discussed during the Public Comment period.

The Board will also provide an opportunity for the public to address the Board on agenda items before or during consideration of the item for up to

two (2) minutes per person for a cumulative total of up to ten (10) minutes.

Members of the public who wish to speak under Public Comments or on any agenda item are required to submit a speaker card to the Executive Officer

prior to the time the item is announced by the Chair for each item they wish to address. Speaker cards are available at the back of the Board Hearing Room. Failure to submit the speaker card in a timely manner may preclude a member of the public from speaking during the subject comment period.

VOTING AND DISPOSITION OF ITEMS - Items require a majority vote of the entire membership of the Board (3 votes) for approval.

Any member of the Board may move to reconsider any vote on any item on the agenda, except to adjourn, suspend the Rules, or where an intervening

event has deprived the Board of jurisdiction, providing that said member originally voted on the prevailing side of the item. The member requesting reconsideration shall identify for all members present the Agenda number, meeting date and subject matter previously voted upon. A motion to reconsider is not debatable and shall require an affirmative vote of three members of the Board.

DISCUSSION

Background

On February 24, 2017 the Board of Public Works awarded a contract to Alameda Construction Services, Inc. in the amount of 1,263,941, with a

contingency amount of 126,394.10 for a total approved construction budget of 1,390,335.10 to design and construct the Ventura Boulevard Sidewalk Improvement project. This project is to design/build sidewalk improvements at various locations along Ventura Boulevard. The project will improve sidewalks along Ventura Boulevard from the 101 Freeway to Goodland Avenue. The improvement will include new sidewalks, driveways, curb ramps, retaining walls and trees.

design and construction cost for an American with Disabilities Act compliant pedestrian crosswalk along the southside of the Ventura Boulevard and

Fairway Avenue intersection. The LADOT provided the conceptual plan that reconfigured the Fairway Avenue alignment at Ventura Boulevard to reduce the cross slope and distance of the proposed crosswalk which also required modifying the existing intersection striping and signals.

The contractor submitted a cost proposal of 238,799.60 for the additional scope; surveying, design, mobilization, construction of pavement, signal

modification, traffic control and striping. This scope addition was offset with 354,356.39 of the net unused bid items quantity adjustments for the project to arrive at a 104,738.07 credit change order. Therefore, an emergency authorization to issue a change order for a not-to-exceed amount of ( 104,738.07) to design and construct additional curb ramps, curb extensions, traffic signal modifications and striping including bid adjustments was requested and approval was received from the BOE Liaison Commissioner (Transmittal No.1). The change order was issued on August 7, 2018 (Transmittal No. 2).

Per the request of the Council District Office (CD-2) and Department of Transportation (DOT), Bureau of Engineering (BOE) requested the contractor to

provide a new design and construction costs for the ADA complaint pedestrian crosswalk along the southside of Ventura Blvd and Fairway Ave intersection. As an alternative, DOT provided the attached red-lined conceptual plan for the curb extension that will reduce the cross slope and distance of the proposed crosswalk. In order to implement the new path of travel along Fairway Ave., the intersection traffic signal needs to be modified and re-striped.

hundred eighteen trees in 2015 as part of ongoing campus and related street improvements. When completed, the applicant shall plant a total of three-hundred twenty-two, 48-inch box size trees of various species. The project is still in progress and applicant shall plant seven, 48-inch box size Southern Magnolia (Magnolia grandiflora) trees to replace the removed trees North Biggy Street. When project is completed, applicant will have replaced all removed trees at a 2. 75:1, exceeding the required 2:1 tree replacement ratio. All replacement trees shall be provided irrigation for a minimum of a three-year period after planting.

RECITAL: The University of Southern California (USC) is currently performing campus improvements and related street improvements as part of the USC

Health and Sciences Campus Project. The project includes many campus upgrades to foster the pedestrian- oriented nature of the area with improvements to aesthetics, landscaping, street lighting, and safety. The project is intended to improve user safety as well as provide residents, workers, and visitors with enhanced walking, biking, and transit while providing a more amicable environment. As part of the enhancements, USC is proposing to install street lights and modify the sidewalk area along the 1400 block of North Biggy Street. The USC was informed that the proposed street lighting improvements may impact existing street trees.

Anthony Bertolini, property owner's representative contacted the Bureau of Street Services (BOSS) regarding the project to address the project's

impact to street trees and secure the necessary tree permit. A Bureau Arborist inspected the subject project location on July 9, 2018 to determine the project's impact to existing street trees. Upon site inspection, plan review, and in communication with the applicant, seven Southern Magnolia (Magnolia grandiflora) trees will be severely impacted by the proposed project. The subject Magnolia trees measure approximately three inches in diameter by fifteen feet in height and are in fair condition growing in four feet tree wells with a nine feet full cemented sidewalk. The subject trees will be impacted by the installation of underground street light utility service lines, proposed streetscape, curb profile, and other project goals and improvements.

Therefore, to allow for infrastructure and streetscape improvements along North Biggy Street, it is recommended that your Board approve the request

for a tree removal permit of seven street trees.

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA): The Department of City planning is acting as the CEQA lead agency. Pursuant to Public Resources Code

Section 21166 and CEQA Guidelines Section 15162, the City must also consider whether there have been any significant changes to the project since certification of the EIR SCH or new information which gives rise to prepare a supplemental or subsequent environmental impact report (Addendum to Environmental Impact/State Clearing House Report). This project will not have a significant environmental effect under the Addendum to the EIR (SCH 2010041 059) as the imposition of the mitigation measures described in the Addendum and incorporated herein as project conditions, there is no substantial evidence the proposed project will have a significant effect on the environment pursuant to the City's Environmental Guidelines and is in compliance with the California Environmental Quality Act (CEQA).
